Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the FlexHR platform, operated by OrganiCode (Pty) Ltd ("we", "us", "our"), a company registered in South Africa. By accessing or using FlexHR, you agree to be bound by these Terms.

2. Service Description

FlexHR is an outsourced payroll and HR services offering operated by OrganiCode. We provide managed payroll processing, SARS submissions, payslip generation and distribution, leave administration, employee self-service, correspondence, reporting, and related HR services, delivered on a cloud-based platform we own and operate.

3. Account Registration

To use FlexHR, you must register for an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscription and Billing

FlexHR is offered on a subscription basis with per-employee-per-month pricing. Specific pricing details are available on our pricing page. We reserve the right to modify pricing with 30 days' notice.

5. User Obligations

You agree to:

  • Use FlexHR only for lawful purposes and in accordance with these Terms
  • Ensure that all data you upload complies with applicable laws, including POPIA
  • Not attempt to reverse-engineer, decompile, or disassemble the platform
  • Not use the service to store or transmit malicious code
  • Maintain adequate security measures for your account

6. Data Ownership

You retain all rights to your data. We do not claim ownership of any employee data, HR records, or other content you upload to FlexHR. We process your data solely to provide the service as described in our Privacy Policy.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We are not liable for any downtime or service interruptions beyond our reasonable control.

8. Limitation of Liability

To the maximum extent permitted by South African law, OrganiCode shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of FlexHR. Our total liability shall not exceed the fees paid by you in the twelve (12) months preceding the claim.

9. Termination

Either party may terminate the subscription with 30 days' written notice. Upon termination, you may request an export of your data within 30 days. After this period, we may delete your data in accordance with our data retention policy.

10. Intellectual Property

FlexHR and all related intellectual property (including software, design, trademarks, and documentation) are owned by OrganiCode (Pty) Ltd. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the platform.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of South Africa.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the platform. Continued use of FlexHR after changes take effect constitutes acceptance of the updated Terms.
